Jim Holperin, Man On The Run

Judge: Complaint can't force Democrat senator in hiding to return | wausaudailyherald.com | Wausau Daily Herald

An Oconto County judge ruled Wednesday that the state Senate 'must enforce its own rules' and refused to order state Sen. Jim Holperin to appear in Madison."

Circuit Judge Jay Conley denied a Lakewood man's emergency request that Holperin be ordered to participate in Senate proceedings. Conley said he wasn't convinced that Holperin is violating his duty as a state senator, writing that any damages the state would suffer as a result of Holperin's absence were "speculative."

Holperin of Conover and his fellow 13 Democratic senators have camped out in Illinois for the last two weeks, preventing passage of Gov. Scott Walker's proposal to end most collective bargaining for public employees.

Kevin Barthel of Lakewood filed a complaint Tuesday arguing that Holperin's refusal to return to the Capitol represents a failure to carry out his duties as an elected official. The complaint still can move forward once it is delivered to Holperin.
