A state Court of Appeals has asked the Wisconsin Supreme Court to decide a contentious fight over the state's new collective bargaining law, which the Dane County district attorney has challenged in court."
"Plainly, this case has broad statewide implications for the general public and those most directly affected by the challenged Act, in addition to those interested in the manner of its passage ...," the judges wrote in certifying the case to the Supreme Court.
Separation of powers
The appeals court avoided the issue of an actual violation, however, and focused instead on the more immediate jurisdictional questions at hand.
Not so fast
Nonetheless, the judges said, a third case, La Follette v. Stitt, in 1983, muddied the waters.
