[Excerpt:] - IRON MOUNTAIN - A man accused of gunning down three teens last week on a river that divides Michigan and Wisconsin could face the death penalty if prosecutors in the two states turn his case over to federal officials. Michigan's Dickinson County Prosecutor Christopher Ninomiya told the Free Press on Sunday that he and his counterparts in Wisconsin may ask the U.S. Attorney's Office to take the case against Scott J. Johnson, 38, of Iron Mountain. If the case is handled federally, "the death penalty comes into play," Ninomiya said. Neither Michigan nor Wisconsin has a death penalty under state law, but because it was an interstate crime - Johnson is accused of killing one teen by firing from the Wisconsin side of the Menominee River into Michigan and two others on the Wisconsin side - a federal indictment could be warranted, Ninomiya said."
